K napísaniu tohto článku nás viedlo zamyslenie nad poslednými hlasovaniami v NR SR, ku ktorým vlastne ani nedošlo, pretože parlament zablokovala opozícia. Samozrejme, najnovšie už aj hlasmi hrdo sa k nej hlásiacich  Sulíkovcov. Nie je podstata v tom, o čom sa hlasovalo. Ide o princíp. Ako to, že sa toleruje, keď poslanec nehlasuje? Ako je vôbec možné, že sa hlasovanie dá takto jednoducho obísť? Veď ide o najpodstatnejší prvok v práci poslancov NR SR. Je ťažké si predstaviť, že by obyčajný zamestnanec prišiel do práce a zamestnávateľovi povedal, že síce je v práci, ale robiť nebude – že sa „zdrží“ práce. Alebo dokonca, že sa ani nebude evidovať v dochádzke – že sa „neprezentuje“, ale mzdu za ten deň očakáva. Presne toto si však poslanci NR SR dovoľujú. Prečo je to tak? Skúsme zapátrať, či za uvedenú vymoženosť niečomu vďačia, alebo či náhodou taká vymoženosť nie je iba výmyslom.

Kde sa vzalo také hlasovanie

Hlasovanie v NR SR upravujú Pravidlá hlasovania na schôdzach Národnej rady Slovenskej republiky (ďalej len „pravidlá“). Tieto pravidlá schválila NR SR uznesením č. 523 zo 4.2.1997. Urobila tak podľa § 39 ods. 7 zákona NR SR č. 350/1996 Z. z. o rokovacom poriadku Národnej rady Slovenskej republiky v znení neskorších predpisov. A čo sa v nich dočítame?

V Čl. 4 Prezentácia poslancov sa ustanovuje, ako sa poslanci prezentujú na rokovaní schôdze národnej rady. Prezentáciou sa zisťuje, cit.: „…účasť poslanca na rokovaní schôdze národnej rady“. Ani slovo o tom, že by sa poslanec, ktorý je prítomný na rokovaní schôdze, teda je prítomný v rokovacej sále parlamentu, nemusel prezentovať. Poslanci sú asi jediní v tejto krajine, kto si slová prítomnosť a účasť vysvetľujú ako ochotu hlasovať. Nevidíme teda vôbec žiadny legitímny priestor na tzv. obštrukciu, ktorou naši poslanci tak radi operujú. Obštrukcia v zmysle, ako si ju poslanci vysvetľujú a praktizujú, je ilúzia, rokovací poriadok nič také nepozná. Počujeme poslancov týmto slovom šermovať buď z nevedomosti (nedôslednej znalosti rokovacieho poriadku), alebo účelovo. Oboje je hanba.

Čo s tým?

Či už tak alebo onak, takúto situáciu podľa nás nemožno akceptovať. Ešte aj podľa Čl. 5 ods. 4 písm. a) pravidiel je úplne zrejmé, že tlačidlo 1 hlasovacieho zariadenia (prezentácia) slúži na vyjadrenie „prítomnosti v rokovacej sále“. Tlačidlo OBŠTRUKCIA sa na hlasovacom zariadení nenachádza. Podľa nášho názoru teda poslanci, ktorí sú prítomní v rokovacej sále, ale neprezentujú sa, porušujú pravidlá, ktoré si parlament sám prijal. Povedené natvrdo – klamú, že tam nie sú a pritom tam sú. Alebo si minimálne robia srandu z rokovacieho poriadku aj zo svojich voličov.

Postup pri samotnom hlasovaní upravuje Čl. 5 pravidiel. Postup umožňuje po prezentovaní sa podľa ods. 4 písm. b) až c) vyjadriť: nesúhlas s predmetom hlasovania, zdržanie sa hlasovania o predmete hlasovania alebo súhlas s predmetom hlasovania. Podľa súčasných pravidiel sa dá hlasovania zdržať. Čistý alibizmus, všakže, ale aspoň takú možnosť rokovací poriadok pozná (na rozdiel od obštrukcie).

Záver

Nikto z nás nemá v práci možnosť šéfovi povedať: Tak vieš čo, dnes sa zdržím práce, lebo neviem, či to mám urobiť alebo nie. Predsa, ak prácu párkrát neurobím, tak zaručene poletím… či?

Preto ani poslanci NR SR, ale ani iní poslanci pri iných hlasovaniach, by nemali mať možnosť sa neprezentovať. Malo by sa im to zakázať a mali by čeliť sankcii, ak sa takého správania dopustia. Alebo, mal by im niekto aspoň vysvetliť, že takýto postup nie je prípustný, pretože nie je nikde ustanovený.

A tiež by nemali mať možnosť sa tváriť alibisticky. Preto by sa mali všetky hlasovania upraviť tak, aby bola možnosť vyjadriť len SÚHLAS alebo NESÚHLAS. Ak ktokoľvek dostal mandát na zastupovanie verejnosti, národa, občanov, nech nesie zodpovednosť za vyjadrenie jednoznačného postoja. Pripomíname, že v referende sa zdržať nedá – ste buď za alebo proti. Povedzte, nie je zdržanie sa hlasovania iba formou politického boja, ktorý by nemal ako vznikať, keby boli politické strany podľa litery zákona striktne oddelené od štátu?

Takže tu máme ďalšiu položku do zoznamu nedostatkov nášho politického systému. Samozrejme, navrhujeme aj riešenie a úpravu príslušných predpisov (pozri Riešenia).
